1. Purpose

These Terms of Use (hereinafter the “Terms”) define the conditions of access and use of the Clinkt.me service by its users, whether they are Creators or Clients.

Clinkt.me acts solely as a technical hosting and file distribution platform.
Clinkt.me does not intervene in the creation, selection, verification, moderation, or modification of user content.

2. Acceptance of the Terms

Any use of Clinkt.me implies full and unconditional acceptance of these Terms.
If the user does not agree with these Terms, they must not use the service.

Part 1: Specific Terms for Creators

2.1 Content Responsibility

The Creator is solely and fully responsible for all files, content, or media they upload, store, sell, or share via Clinkt.me.

Clinkt.me performs no prior control or monitoring of uploaded content and cannot be held liable for the legality, accuracy, compliance, or consequences of such content.

The Creator guarantees that:

they hold all necessary rights to upload, distribute, and sell the content,
the content complies with applicable laws and regulations,
the content does not infringe third-party rights,
the content does not contain sensitive or confidential information.

2.2 Blocked and Prohibited Content Policy

The following content is strictly prohibited on Clinkt.me, regardless of the context or intended use:

Any illegal content under French, European, or international law
Child sexual abuse material or any content involving minors
Human trafficking, exploitation, or abuse-related content
Content promoting violence, terrorism, hatred, or discrimination
Non-consensual sexual content
Confidential, protected, or classified information
Sensitive personal data as defined by Article 9 of the GDPR
Fraudulent, deceptive, or misleading content
Content infringing intellectual property or third-party rights

Clinkt.me reserves the right to remove any prohibited content and take appropriate action without prior notice.

2.3 Prohibition of Human Trafficking and Exploitation

Clinkt.me has a zero-tolerance policy toward any form of human trafficking, exploitation, or modern slavery.

Any content related to:

human trafficking,
sexual exploitation,
forced labor,
coercion, abuse of vulnerability, or organized exploitation,

is strictly prohibited.

Any violation will result in immediate account suspension or termination, and Clinkt.me may cooperate with competent authorities without prior notice.

2.4 Underage Content Policy

Any content involving minors is strictly prohibited on Clinkt.me.

This includes, without limitation:

sexualized or suggestive content involving minors,
images, videos, or audio depicting minors in an exploitative or inappropriate manner,
content facilitating or promoting harm to minors.

Any violation will result in immediate account termination and may be reported to the relevant authorities.

2.5 Disputes and Transactions

In the event of a disputed transaction, Clinkt.me reserves the right to temporarily withhold all or part of the balance related to that transaction until the issue is resolved.

Clinkt.me acts solely as a technical intermediary and is not a party to transactions between Creators and Clients.

2.6 Withdrawals and Payouts

Each Creator is solely responsible for the accuracy of the banking information provided when requesting a withdrawal (including IBAN, account holder name, country, and any required details).

Clinkt.me cannot be held liable for:

errors made by the user when entering banking information,
failed, delayed, or misdirected transfers resulting from incorrect data,
financial losses caused by the user’s mistake.

Once a withdrawal request has been executed, no cancellation, modification, or recovery can be guaranteed.

2.7 AI-Generated Content

AI-generated content is permitted provided it complies with applicable laws and these Terms.

The Creator remains fully responsible for any AI-generated content uploaded to Clinkt.me.
In case of abuse or violation, Clinkt.me may remove the content or suspend the account.

Part 2: Specific Terms for Clients

3.1 Use of Purchased Files

The Client is solely responsible for the use of downloaded files.

Any unauthorized use (resale, redistribution, sharing, modification, or public broadcasting) is prohibited unless expressly authorized by the Creator.

Clinkt.me provides no guarantee regarding the quality, legality, or compliance of files sold by Creators.

4. Account Security and Personal Use

Each user account is strictly personal and may not be shared with third parties.

Clinkt.me shall not be held liable for any issue, dispute, damage, or misuse resulting from:

account sharing,
unauthorized access due to insufficient credential protection,
actions performed by third parties using the user’s account.

An exception applies only when using the Agency mode, where access permissions are explicitly configured by the account owner.
Outside of this feature, account sharing is done entirely at the user’s own risk.

5. Complaint Handling Procedure

Any user or third party may report content or behavior believed to be illegal, abusive, or in violation of these Terms.

Complaints must be sent to: [email protected]
and include, where possible:

a description of the issue,
the URL or identifier of the content concerned,
any relevant supporting information.

Upon receipt of a valid complaint, Clinkt.me may take appropriate action, including content removal, account suspension, or cooperation with authorities.

Clinkt.me is not obligated to respond to incomplete, abusive, or manifestly unfounded complaints.

In accordance with the General Data Protection Regulation (GDPR):

Users may request deletion of their personal data at any time by emailing: [email protected]
Users may freely subscribe or unsubscribe from communications
No marketing messages are sent without explicit consent
Clinkt.me does not access or analyze user content except when legally required or following a valid complaint
Data is hosted on AWS servers (Amazon)
Uploaded files are stored for a maximum of 7 days and are automatically deleted
Once deleted, files cannot be recovered

7. Limitation of Liability and Indemnification

Clinkt.me cannot be held liable for indirect damages, loss of data, loss of revenue, or reputational harm arising from the use of the service.

The user agrees to indemnify and hold harmless Clinkt.me, its directors, employees, and partners from any claim, action, damage, fine, or expense (including legal fees) resulting from:

uploaded or sold content,
violation of these Terms,
infringement of applicable laws or third-party rights.

8. Modification of the Terms

Clinkt.me may modify these Terms at any time.
In the event of a major update, users will be informed by email or via site notification.

9. Governing Law

These Terms are governed by French law.
Any dispute shall fall under the exclusive jurisdiction of the competent courts of France.

10. Glossary

Creator: A user who offers digital files for sale via Clinkt.me.
Client: A user who purchases one or more files uploaded by a Creator.
Upload: The action of transferring a file to the Clinkt.me platform.
Media: Any digital content (image, video, audio, text, or archive).
Link: A URL giving access to a file or page on Clinkt.me.
AI-generated Content: Content created using artificial intelligence tools.
Disputed Transaction: A payment contested by a user or subject to a claim.
