  1. Purpose

These Terms of Use (hereinafter the “Terms”) define the conditions of access and use of the Clinkt.me service by its users, whether they are Creators or Clients.

Clinkt.me acts as a technical hosting and file distribution platform. User content is subject to a Content Moderation Policy, and Clinkt.me may take moderation actions in accordance with these Terms.

Clinkt.me provides the Service on an “as is” basis. While we aim to ensure availability and reliability, the Service may be temporarily unavailable or disrupted due to maintenance, updates, technical incidents, third-party network issues, security measures, or requests from competent authorities.

  1. Acceptance of the Terms

Any use of Clinkt.me implies full and unconditional acceptance of these Terms. If the user does not agree with these Terms, they must not use the service.

  1. Service Availability, Maintenance and Force Majeure

Clinkt.me uses reasonable efforts to keep the Service available. However, Clinkt.me does not guarantee uninterrupted or error-free operation.

Clinkt.me may suspend, limit, or interrupt access to the Service for maintenance, updates, security reasons, incident response, or to comply with legal obligations or instructions from competent authorities.

Clinkt.me shall not be liable for any failure or delay resulting from events beyond its reasonable control (force majeure), including internet or telecom failures, third-party service outages, cyberattacks, or acts/requests of public authorities.

Part 1: Specific Terms for Creators 4.1 Content Responsibility

The Creator is solely and fully responsible for all files, content, or media they upload, store, sell, or share via Clinkt.me.

Clinkt.me may perform content moderation actions in accordance with its Content Moderation Policy, including based on user reports, human review, automated detection signals, compliance checks, or legal requirements. However, moderation does not constitute a guarantee that all content is reviewed or that prohibited content will never be present on the platform.

Where applicable, content (or content fingerprints/metadata) may be processed by third-party service providers solely for the purpose of detecting unlawful or prohibited content and enforcing the Terms.

Clinkt.me may report suspected illegal content or activity to competent authorities where required or appropriate.

The Creator guarantees that:

they hold all necessary rights to upload, distribute, and sell the content,

the content complies with applicable laws and regulations,

the content does not infringe third-party rights,

the content does not contain sensitive or confidential information.

4.2 Blocked and Prohibited Content Policy

The following content is strictly prohibited on Clinkt.me, regardless of the context or intended use:

Any illegal content under French, European, or international law

Child sexual abuse material or any content involving minors

Human trafficking, exploitation, or abuse-related content

Content promoting violence, terrorism, hatred, or discrimination

Non-consensual sexual content

Confidential, protected, or classified information

Sensitive personal data as defined by Article 9 of the GDPR

Fraudulent, deceptive, or misleading content

Content infringing intellectual property or third-party rights

Clinkt.me reserves the right to remove, restrict access to, or disable any prohibited content and take appropriate action, including account suspension or termination, in accordance with its Content Moderation Policy and applicable law.

4.3 Prohibition of Human Trafficking and Exploitation

Clinkt.me has a zero-tolerance policy toward any form of human trafficking, exploitation, or modern slavery.

Any content related to:

human trafficking,

sexual exploitation,

forced labor,

coercion, abuse of vulnerability, or organized exploitation,

is strictly prohibited.

Any violation will result in immediate account suspension or termination, and Clinkt.me may cooperate with competent authorities without prior notice.

4.4 Underage Content Policy

Any content involving minors is strictly prohibited on Clinkt.me.

This includes, without limitation:

sexualized or suggestive content involving minors,

images, videos, or audio depicting minors in an exploitative or inappropriate manner,

content facilitating or promoting harm to minors.

Any violation will result in immediate account termination and may be reported to the relevant authorities.

4.5 Disputes and Transactions

In the event of a disputed transaction, Clinkt.me reserves the right to temporarily withhold all or part of the balance related to that transaction until the issue is resolved.

Clinkt.me acts solely as a technical intermediary and is not a party to transactions between Creators and Clients.

4.6 Withdrawals and Payouts

Each Creator is solely responsible for the accuracy of the banking information provided when requesting a withdrawal (including IBAN, account holder name, country, and any required details).

Clinkt.me cannot be held liable for:

errors made by the user when entering banking information,

failed, delayed, or misdirected transfers resulting from incorrect data,

financial losses caused by the user’s mistake.

Once a withdrawal request has been executed, no cancellation, modification, or recovery can be guaranteed.

4.7 AI-Generated Content

AI-generated content is permitted provided it complies with applicable laws and these Terms.

The Creator remains fully responsible for any AI-generated content uploaded to Clinkt.me. In case of abuse or violation, Clinkt.me may remove the content, restrict access, or suspend the account in accordance with its Content Moderation Policy.

Part 2: Specific Terms for Clients 5.1 Use of Purchased Files

The Client is solely responsible for the use of downloaded files.

Any unauthorized use (resale, redistribution, sharing, modification, or public broadcasting) is prohibited unless expressly authorized by the Creator.

Clinkt.me provides no guarantee regarding the quality, legality, or compliance of files sold by Creators.

  1. Account Security and Personal Use

Each user account is strictly personal and may not be shared with third parties.

Unless Clinkt.me is notified of a compromise, any action performed through a user account is presumed to have been performed by the account holder.

Clinkt.me shall not be held liable for any issue, dispute, damage, or misuse resulting from:

account sharing,

unauthorized access due to insufficient credential protection,

actions performed by third parties using the user’s account.

Clinkt.me may take protective measures in case of suspected compromise or security risk (e.g., password reset, access limitation, temporary suspension).

An exception applies only when using the Agency mode, where access permissions are explicitly configured by the account owner. Outside of this feature, account sharing is done entirely at the user’s own risk.

  1. Complaint Handling Procedure (Notice & Action)

Any user or third party may report content or behavior believed to be illegal, abusive, or in violation of these Terms.

Complaints must be sent to: [email protected]

and include, where possible:

a description of the issue,

the URL or identifier of the content concerned,

any relevant supporting information.

Clinkt.me acts as a hosting provider for Creator content and may only be able to act upon content once it has been sufficiently notified or otherwise becomes aware of content that is manifestly unlawful under applicable law.

Upon receipt of a valid complaint, Clinkt.me may take appropriate action in accordance with its Content Moderation Policy, including content removal, restriction of access, account suspension, or cooperation with authorities.

Clinkt.me is not obligated to respond to incomplete, abusive, or manifestly unfounded complaints.

  1. Personal Data and GDPR

In accordance with the General Data Protection Regulation (GDPR):

Users may request deletion of their personal data at any time by emailing: [email protected]

Users may freely subscribe or unsubscribe from communications

No marketing messages are sent without explicit consent

Clinkt.me may access, review, or process user content for moderation and compliance purposes, when legally required, or following a valid complaint

Data is hosted on AWS servers (Amazon)

Uploaded files are stored for a maximum of 7 days and are automatically deleted

Once deleted, files cannot be recovered

  1. Limitation of Liability and Indemnification

Clinkt.me cannot be held liable for indirect damages, loss of data, loss of revenue, or reputational harm arising from the use of the service.

To the maximum extent permitted by applicable law, Clinkt.me’s total liability arising out of or in connection with the Service shall be limited to the amounts of fees actually received by Clinkt.me in relation to the transaction or the user concerned during the three (3) months preceding the event giving rise to the claim.

The user agrees to indemnify and hold harmless Clinkt.me, its directors, employees, and partners from any claim, action, damage, fine, or expense (including legal fees) resulting from:

uploaded, stored, shared, or sold content,

violation of these Terms,

infringement of applicable laws or third-party rights.

This indemnification covers, without limitation, claims relating to: (i) intellectual property infringement, (ii) personal data/privacy violations, (iii) defamation or reputational harm, (iv) unlawful or prohibited content, and (v) any breach of contractual obligations by the user toward third parties.

  1. Suspension and Termination

Clinkt.me may suspend or terminate access to the Service immediately, without prior notice, in case of breach (or suspected breach) of these Terms, security risk, fraud, payment incidents, or legal compliance requirements.

Upon suspension or termination, Clinkt.me may:

remove or restrict access to content,

withhold payouts as permitted in case of disputes, fraud, or legal compliance checks,

restrict the user from creating new accounts where permitted by law.

Termination does not affect any rights or obligations that, by their nature, should survive termination (including liability limitations and indemnification).

  1. Modification of the Terms

Clinkt.me may modify these Terms at any time. In the event of a major update, users will be informed by email or via site notification.

  1. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect.

  1. No Waiver

Any failure by Clinkt.me to enforce any provision shall not constitute a waiver of future enforcement of that or any other provision.

  1. Assignment / Change of Control

Users may not assign these Terms without Clinkt.me’s prior written consent. Clinkt.me may assign these Terms in connection with a merger, acquisition, reorganization, or change of control, where permitted by law.

  1. Governing Law

These Terms are governed by French law. Any dispute shall fall under the exclusive jurisdiction of the competent courts of France.

  1. Glossary

Creator: A user who offers digital files for sale via Clinkt.me. Client: A user who purchases one or more files uploaded by a Creator. Upload: The action of transferring a file to the Clinkt.me platform. Media: Any digital content (image, video, audio, text, or archive). Link: A URL giving access to a file or page on Clinkt.me. AI-generated Content: Content created using artificial intelligence tools. Disputed Transaction: A payment contested by a user or subject to a claim.
